Steve: Brenda, thank you for having me. Providing notice is a fundamental step in ensuring transparency and fairness throughout the probate process. Essentially, it involves informing all interested parties about the decedent’s passing and the initiation of probate proceedings.

This includes publishing a notice in a local newspaper three times, mailing notices to identified heirs and beneficiaries, and formally notifying known creditors using Form DE-157. Consequently, this step allows everyone with a potential claim or interest in the estate to come forward and participate in the process.

Moreover, providing notice helps prevent any surprises or disputes down the line. By openly communicating the probate proceedings, we aim to foster trust and understanding among all stakeholders.

Notably, it’s crucial to remember that California Probate Code Section 8120 outlines specific requirements for providing notice, so adherence to these legal guidelines is paramount.

One instance I vividly recall involved a family where the deceased had estranged siblings. Due to the lapse in communication, locating these siblings proved challenging. Nevertheless, through meticulous research and collaboration with genealogists, we were able to locate them and ensure they received proper notice. It was a testament to the importance of diligence in this step.
