Reporter: Brenda Sanchez
Welcome back to Wildomar Weekly News, I’m Brenda Sanchez. Today we have the pleasure of speaking with local estate planning attorney Steve Bliss of Wildomar Probate Law. Steve, thanks for joining us.
Steve Bliss: Thank you for having me, Brenda. It’s great to be here.
Steve, for our viewers who may not be familiar with estate planning, can you briefly explain why it’s so important?
Steve Bliss:
Estate planning is essentially about ensuring your wishes are carried out after you pass away. It involves creating a roadmap for how your assets will be distributed, who will care for any minor children, and designating someone to manage your affairs if you become incapacitated.
Many people think estate planning is only for the wealthy, but that’s simply not true. Everyone, regardless of their financial situation, can benefit from having a plan in place.
Brenda Sanchez:
That makes sense. Today I wanted to focus on one specific step in the estate planning process. Could you elaborate on the importance of selecting an Executor or Trustee?
Steve Bliss:
Selecting the right Executor or Trustee is crucial, as they will be responsible for carrying out your wishes after you’re gone. This person will manage your assets, pay off any debts, and distribute the remaining property according to your instructions.
Consequently, it’s essential to choose someone trustworthy, organized, and capable of handling complex financial matters.
Ordinarily, people choose a family member or close friend for this role. However, you can also appoint a professional trustee if you prefer. The key is to select someone who understands your wishes and will act in the best interests of your beneficiaries.
Moreover, I often advise clients to have a backup executor or trustee in case their first choice is unable or unwilling to serve.
Brenda Sanchez:
Have you ever encountered any challenges related to Executor selection?
There was one instance where a client named his brother as Executor, but they hadn’t spoken in years due to a family dispute.
Unfortunately, the brother declined the responsibility, leading to delays and complications in settling the estate.
It highlighted the importance of open communication and choosing someone who has a strong relationship with the beneficiaries.
Brenda Sanchez:
That’s a valuable lesson. What advice would you give to our viewers who are considering starting their estate plan?
Steve Bliss:
My biggest piece of advice is to not wait. Start planning now, even if you think you don’t have much to leave behind.
According to a recent survey by Caring.com, over 60% of Americans do not have a will in place. This means their assets will be distributed according to state law, which may not align with their wishes.
Taking the time to create an estate plan can save your loved ones from unnecessary stress and heartache down the road.
Brenda Sanchez:
Steve, this has been incredibly insightful. How can our viewers get started on their own estate plans?
Steve Bliss:
