A Chat With Ted Cook: Protecting Our Most Vulnerable

Hello everyone and welcome back to the show! Today we have a truly inspiring guest, Ted Cook, an elder protection attorney right here in sunny San Diego. Ted, thanks so much for joining us.

So Ted, what exactly is Elder Protection and why is it so important?

“Well, simply put,” Ted begins with a warm smile, “Elder Protection is all about safeguarding our senior citizens from abuse, neglect, and exploitation. It’s a critical field because seniors are often vulnerable to financial scams, physical harm, and emotional manipulation due to factors like age-related cognitive decline or isolation.” He leans forward earnestly. “My goal as an elder protection attorney is to empower seniors and their families to navigate these complex issues and ensure their safety and well-being.”

Tell us a bit about the Elder Protection process – what steps are involved?

Ted pulls out a neatly organized diagram outlining the stages.

  • A. Initial Client Engagement
  • B. Case Assessment
  • C. Protective Actions
  • D. Legal Proceedings
  • E. Long-Term Planning
  • F. Case Resolution & Follow-Up

“This roadmap helps us address each case systematically and comprehensively,” Ted explains. “We start with a thorough client intake, gathering essential information about the situation and the individual’s needs. Then we carefully assess the legal issues at hand and develop a tailored plan to protect our clients.”

Let’s delve into one of those steps – how about Protective Actions?

Ted nods, “Protective Actions are often the most crucial stage because they involve taking immediate steps to mitigate harm. Depending on the situation, this could include obtaining restraining orders against abusers, notifying Adult Protective Services (APS), or even petitioning for guardianship or conservatorship if the senior lacks capacity to make sound decisions.”

“Ted helped me protect my mother from financial abuse by her caregiver. He was incredibly compassionate and fought tirelessly to get justice for her.” – Mary S., La Jolla.

He continues, “We might also freeze bank accounts to prevent further exploitation, initiate power of attorney revocations if necessary, or help the senior transition to a safer living environment.”

Have you encountered any challenges in implementing Protective Actions?

“Certainly,” Ted acknowledges. “Sometimes family members are reluctant to acknowledge abuse or get involved. There was this one case where a daughter refused to believe her father was being financially exploited by his new ‘friend.’ It took time and careful communication to convince her that intervention was necessary, but ultimately she came around and we were able to protect her father’s assets.”

“Another challenge is dealing with resistant abusers. They might try to intimidate the senior or deny any wrongdoing,” Ted adds thoughtfully. “In those situations, it’s crucial to gather strong evidence and work closely with law enforcement if necessary. It can be a complex and emotionally charged process, but seeing seniors regain their safety and dignity makes it all worthwhile.”

“I was at my wit’s end trying to help my elderly aunt who was being neglected in her care facility. Ted stepped in and helped me get her the proper care she deserved. I can’t thank him enough.” – John M., Point Loma.

“As a geriatric social worker, I often refer families to Ted Cook when they need legal assistance. He is a true advocate for seniors and has an incredible track record of success.” – Susan L., San Diego.

Ted smiles warmly. “If you or someone you love needs help navigating the complexities of elder protection, please don’t hesitate to reach out. Protecting our elders is everyone’s responsibility.”
