Hello everyone, and welcome back. Today, we’re sitting down with the insightful Ted Cook, a trust administration attorney based right here in sunny San Diego.
Ted, what initially drew you to this field of law?
“You know, it’s fascinating. Trust administration allows me to help families navigate a potentially difficult time with compassion and clarity. It’s about ensuring someone’s wishes are honored, assets are protected, and loved ones receive what they’re entitled to.
So many people don’t understand trust administration – can you give us a quick overview?
Absolutely! Essentially, trust administration is the process of managing a trust after its creator (the “settlor”) passes away. It involves locating and valuing assets, paying debts and taxes, distributing funds to beneficiaries, and ultimately closing the trust.
Could you elaborate on one specific step in this process?
Let’s talk about ‘Identifying and Notifying All Relevant Parties.’ This is crucial because it ensures transparency and fairness. We need to identify all beneficiaries named in the trust document, as well as any heirs-at-law who may have a legal claim.
Once we’ve identified them, we must provide formal notification about the settlor’s passing and inform them of their rights under the trust. This often involves explaining complex legal concepts in a clear and understandable way.
- “It’s like being a translator,” Ted explains. “We take those legal terms and translate them into everyday language so everyone understands what’s happening.”
“Ted made the entire trust administration process much less daunting than I anticipated. He was patient, answered all my questions, and kept me informed every step of the way.” – Sarah M., La Jolla
He recalls a case where he had to locate distant relatives who were unaware of their inheritance. It involved some detective work – tracking down addresses, making phone calls, and even using online genealogy resources.
“It was incredibly rewarding to connect those family members with what they were rightfully owed,” Ted says.
That sounds like a complex undertaking! What are some common challenges you face during this step?
“Ted’s knowledge and guidance were invaluable during a difficult time for my family. He helped us navigate the complexities of trust administration with empathy and expertise.” – John B., Point Loma
“Sometimes, locating beneficiaries can be like finding needles in a haystack,” Ted admits. “Addresses change, contact information becomes outdated, and sometimes family members have strained relationships, making communication challenging.”
In these cases, Ted emphasizes the importance of thorough research and creative problem-solving. He might use public records, online databases, or even hire private investigators to track down missing beneficiaries.
Ted, it sounds like you go above and beyond for your clients. How can people connect with you if they need assistance?

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
