What prompted you to specialize in Guardianship Law?

It all started during law school. I took an elective course on elder law, and I was immediately drawn to the human element of it. Understanding how we can best protect and support vulnerable individuals really resonated with me. Guardianship is a crucial safety net for people who are unable to make sound decisions for themselves, whether due to age, disability, or illness.

Let’s talk about the process itself. Could you walk us through one of the key steps?

Absolutely! Let’s delve into step D: Court Investigation and Evaluation. This is a crucial stage where the court wants to ensure that guardianship is truly necessary and in the best interest of the individual.

A court-appointed investigator, often called a guardian ad litem, takes on the responsibility of thoroughly assessing the situation. They interview the proposed ward – the person who may need a guardian – to understand their wishes and capabilities. The investigator also visits the proposed ward’s living environment, speaks with family members and caregivers, and reviews any relevant medical or psychological evaluations.

  • The goal is to paint a complete picture of the individual’s needs and abilities.

This investigation culminates in a detailed report submitted to the court. The judge then uses this report, along with other information, to make an informed decision about whether to grant guardianship.

There have been a few instances where investigations revealed complexities I hadn’t anticipated. Once, we were dealing with a case where the proposed ward had a history of mental illness but was vehemently opposed to guardianship. The guardian ad litem spent considerable time building rapport with him and understanding his concerns. Ultimately, we were able to work out a limited guardianship arrangement that addressed both his needs and his desire for autonomy.

Another situation involved a family dispute over who should be appointed as guardian. The investigation uncovered underlying tensions and unresolved issues within the family. It required careful negotiation and mediation to reach a solution everyone could accept.
