Steve, can you walk our viewers through one of the key steps involved in probate?
Certainly. One crucial step is “Marshaling the Estate Assets”. This involves a thorough inventory and valuation of all assets belonging to the deceased individual’s estate.
Consequently, it requires meticulous record-keeping and attention to detail. We need to identify and document everything from bank accounts and real estate holdings to personal property like vehicles and jewelry. Moreover, obtaining appraisals for assets like real estate or artwork is often necessary to determine their fair market value.
Once a complete inventory has been compiled, we file an Inventory and Appraisal (Forms DE-160/161) with the probate court. This document serves as a transparent record of the estate’s assets for all interested parties, including heirs, beneficiaries, and creditors.
Challenges in Marshaling Estate Assets
Have you encountered any particular challenges while marshaling estate assets?
There have been instances where locating all assets proved difficult. I recall one case involving a client who had amassed a significant collection of rare coins over the years. The collection was scattered across various safe deposit boxes and personal storage units, making it a real treasure hunt to locate everything.
Notwithstanding these hurdles, we were able to meticulously track down each coin and secure its appraisal. The client’s family was deeply grateful that we ensured their inheritance was complete.
According to the California Probate Courts, approximately 20% of probate cases involve complex asset searches. That underscores the importance of working with an experienced probate attorney who can navigate these complexities effectively.
