Steve, can you explain what a testamentary trust is and how it differs from other types of trusts?
Steve’s Explanation
Certainly. A testamentary trust is unique because it’s created through a will and only comes into effect after the grantor, the person who creates the trust, passes away. Unlike revocable living trusts, which can be modified during the grantor’s lifetime, testamentary trusts are irrevocable. This means the terms cannot be changed once the will goes through probate.
Consequently, testamentary trusts are often used when someone wants to provide for beneficiaries who may not be ready to manage their inheritance responsibly, such as minor children or individuals with special needs. The trustee, appointed in the will, manages the assets according to the grantor’s instructions and distributes them to the beneficiaries over time.
Moreover, testamentary trusts can offer asset protection. For instance, if a beneficiary is going through a divorce or facing creditor claims, the assets held within the trust may be shielded from those liabilities. This added layer of protection can provide peace of mind for both the grantor and the beneficiaries.
Notwithstanding these advantages, testamentary trusts do go through probate, which can be a lengthy and sometimes costly process. It’s essential to weigh the benefits against the potential drawbacks when deciding if a testamentary trust is right for your estate plan.
