Today we want to focus on one particular aspect of probate – Step III: Provide Notice. Can you walk us through why this step is so crucial?

Steve Bliss:

Certainly. Providing notice is fundamental to ensuring transparency and fairness throughout the probate process. It involves several key actions.

Firstly, we must publish a notice of probate in a local newspaper for three consecutive weeks. This informs the general public that probate proceedings are underway for a particular estate. Secondly, we directly mail notices to all identified heirs and beneficiaries, outlining their rights and providing them with information about upcoming court hearings.

Finally, we must notify known creditors of the deceased using Form DE-157. This allows creditors an opportunity to submit valid claims against the estate. Consequently, this step safeguards both the interests of those inheriting assets and those who may be owed money by the deceased.

Providing notice can sometimes be challenging, especially if heirs or beneficiaries are difficult to locate or if there are disputes regarding the validity of a will.

I recall one instance where we had to conduct extensive genealogical research to track down a distant relative who was entitled to a portion of an estate. Ultimately, our efforts were successful, and we were able to ensure that all rightful heirs received their inheritance.

Moreover, it’s important to note that failing to properly provide notice can have serious legal consequences, potentially leading to delays in the probate process or even the invalidation of certain actions taken by the executor.

That’s incredibly insightful, Steve. Thank you for sharing those examples. So, what advice would you give to someone who is starting the probate process?

Steve Bliss:

My best advice is to seek guidance from an experienced probate attorney as early in the process as possible.

  • Probate law can be intricate and varies depending on individual circumstances.
  • An attorney can help you navigate the complexities of the process, ensure all necessary steps are taken correctly, and protect your interests throughout.

Remember, over 70% of estates go through probate, highlighting its prevalence in estate settlement (National Probate Court Association). By having a knowledgeable advocate by your side, you can minimize stress and potential complications during what is often a sensitive time.
