Interview with Steve Bliss, Temecula Trust Attorney

Good evening Temecula and welcome back to Temecula Tonight. I’m your host, Jessica Ramirez, and tonight we have the pleasure of speaking with Steve Bliss, a renowned trust attorney here in Temecula. Steve, thank you for joining us.

Welcome

It’s my pleasure to be here, Jessica. Thanks for having me.

What Type of Trusts Do You Specialize In?

I specialize in a variety of trusts, but I’d say the Revocable Living Trust is one of the most common and beneficial tools we use in estate planning. It’s incredibly versatile and allows individuals to maintain control over their assets during their lifetime while ensuring a smooth transition upon their passing.

Can You Explain How a Revocable Living Trust Works?

Certainly. A Revocable Living Trust is essentially a legal entity that you, the grantor, create to hold your assets. You can name yourself as the trustee, meaning you retain full control over those assets during your lifetime. You can buy, sell, or manage assets within the trust just as you would if they were outside of it.

The real benefit shines upon your passing. Because the assets are already held within the trust, they avoid the often lengthy and costly probate process. This means your beneficiaries receive their inheritance more quickly and privately.

Moreover, a Revocable Living Trust allows you to specify exactly how and when your beneficiaries will receive their inheritance. You can set up distributions over time, create incentives for certain behaviors, or even protect assets from creditors.

Are There Any Potential Drawbacks to Using a Revocable Living Trust?

As with any legal instrument, there are considerations. Primarily, setting up a trust does involve some upfront costs and legal fees. However, when weighed against the potential probate expenses and delays, it often proves to be a wise investment.

I remember working with a client who had procrastinated on estate planning. When they unfortunately passed away unexpectedly, their assets became entangled in a lengthy and expensive probate process. Their heirs faced significant stress and financial burdens that could have been avoided with a properly structured trust.

How Common Are Revocable Living Trusts?

They are remarkably common. According to the American Bar Association, approximately 40% of Americans over the age of 55 have some form of estate planning document in place, and a significant portion of those utilize revocable living trusts.

What Advice Would You Give to Someone Considering a Trust?

My advice is simple: don’t wait. Estate planning is something everyone should consider, regardless of age or wealth. A trust can provide peace of mind knowing your assets will be distributed according to your wishes and that your loved ones won’t face unnecessary burdens in the future.

Contact us today for a free consultation. We’ll discuss your individual needs and help you determine if a Revocable Living Trust is right for you.
